He will be charged with Speeding and Transportation of a Controlled Drug and possibly Possession of a Controlled Drug. The Speeding charge is a civil infraction and will not result in a criminal record. The drug charges will be brought a criminal offenses and may result in criminal conviction and record. The Transportation of a Controlled Drug is considered a major motor vehicle violation and will result in 6 point on his license. As he is under 20 he will also be subject to additional license penalties through the DMV. I would strongly suggest you consult with an attorney.

The amount of time depends on the charge that he's on probation for. The punishment for probation violations can be as low as no jail to as high as the maximum amount of time for the charge that he's on probation for. The judge has the final say in how much punishment is warranted, but will listen to comments from the DA, the defense lawyer, and probation.

If the State picked up the charges you will definitely need an attorney. Your brother doesn't have any control over whether the State pursues the charges, at this point. There are things he can do to help resolve the case favorably, that can be discussed with your attorney. His regret and unwillingness to testify MAY help you, but the DA's office can still pursue the charge. The sooner you meet with an attorney and discuss these issues the better able he/she will be equipped to help you resolve this in your favor.   Best of luck.
