Can you be charged with drug paraphernalia if someone has already claimed it?

default-avatar
Answered by attorney Andrea Rogers (Unclaimed Profile)
Criminal Law lawyer at The Rogers Law Firm
Yes, this is very common. The police officers often charge everyone who had access to the paraphernalia. So, if you were in a car and the cop pulls you over and finds drug paraphernalia in the car, he charges everyone in the car with possession of drug paraphernalia. Their thinking is that you all had access to it, so it wouldn't be fair to charge just one occupant of the vehicle with possession. They know that one person will often try to take the fall for everyone else in the car, so they charge every occupant of the car with possession.

Can I own a registered gun although my husband is a convicted felon of drug possession?

Answered by attorney Harley Ives Gutin
Criminal Law lawyer at Gutin Wolverton
You can own a gun and possess it. Your Husband cannot have access to it. It must be under lock and key or a combination that he does not know or have access to. Having said that they can still arrest him if the authorities find out a convicted felon is in the house where there is a gun. However, I think he would be found not guilty if the gun, was in a safe, in a room the Husband did not have access to.

What can I do if the police searched my house without a search warrant?

Your description does not provide sufficient detail to answer your question. The law of search warrants and search/seizure is complex and fact-intensive. You should contact counsel who can provide you with a thorough analysis.
