The penalty for violating probation is the penalty for the underlying charge that you were on probation for originally. So, if you were on probation for Larceny Over $250 that bears a maximum penalty of up to 2.5 years in the house of correction, a violation of that probation allows the judge, upon a finding that your boyfriend did in fact violate, to sentence him to anything from nothing to 2.5 years in the House of Correction. A new charge is a violation since the very first term of every probation is to not get into further criminal trouble. Now, having said that, although the court can sentence up to the max of the underlying crime, it is rare that they do. It will depend on a lot of other factors such as, his previous criminal history, how he did with other terms of probation, and how good his lawyer is.

Based on the facts you present, you have a defense in your case which could result in a dismissal of your case. However, it is not automatic, and may have to be accomplished through a trial and the jury would need to believe your presentation of the facts. Without a witness seeing you drive, and without you admitting that you were driving, there is little to show that you were driving a vehicle in this case.
