It would depend on the rules of the State in which the record was expunged. In California, it would depend if the record was expunged AND reduced pursuant to 17b. In Colorado, there is no expungement for adult felony convictions. There are ealing options, but those are the same as expungements.

It seems like this could be a burglary case with multiple charges - if there is no prior record, likely probation if there is a prior record of felonies, then maybe com cor or prison could get up to 12 on each burg, 6 on each theft - stacked - but that is not likely call to discuss representation.

Do you mean that the State has not filed formal charges against the Defendant? They have 33 days, extended to 40 with good cause to file charges. A felony case can take many months to resolve, and assuming that the state has filed formal charges already, they have until the defense says that they are ready to go to trial. Many state attorneys don't really study the case until just before trial. There are usually pre-trials every month. More needs to be known before a complete and correct answer can be given. Consult an attorney.
