What are my options if the arresting officers read me my rights after I was initially questioned?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
It depends. They would only have to read you your rights if you were in their custody. It would depend on when and where the first set of questioning took place. Have an experienced criminal attorney review the record and police report to determine if it was proper or not and what motions may be made regarding it.

How much jail time can be expected for counts of possession with intent to distribute?

Answered by attorney Kevin T. Ellmann
Criminal Law lawyer at Ellmann & Ellmann, P.C.
The amount of possible jail or prison she is likely to get if any depends upon several factors like amounts; relative level of culpability vs. that of co-defendant; jurisdiction; DA; judge, etc. Bottom line, when facing felony charges, it is critical to get the assistance of an experienced defense attorney to minimize not only the immediate, but also the long-term consequences of a felony charge.

Can a police still ask you some questions after asking for a attorney?

Answered by attorney Craig W Elhart (Unclaimed Profile)
Criminal Law lawyer at Craig W. Elhart, PC
When you ask for an attorney questioning should stop. That means you should refuse to answer any further questions. If you did answer, your attorney will have to review the circumstances to determine whether a motion ot quash would be in order.
