The Fifth Amendment protects a person from having to testify against him/her self. Any person who's testimony could implicate them in criminal activity could invoke their Fifth Amendment right against self incrimination.

The court had to correct the illegal sentence.  However it's not clear from your question whether he was offered his plea back; or if this would have helped him.  This is usually what the court will do when the agreed upon sentence is illegal.

No it does not. The DA would have to show knowledge that the property was stolen and that your son actually possessed it (being in the room is not enough).
