Can she still press charges for trespassing after a month?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Sounds like blackmail. Make sure you get all of this in writing. They can honestly press charges for up to 2 years after the incident. They would have to call the police and make a report first though.

Can the cops put out a warrant without filing a report?

Answered by attorney Laurie A. Schmidt
Criminal Law lawyer at 5280 Law Group
If you are going to be charged with a crime, most likely domestic violence related, one of two things will occurr - 1. The cops will try and contact you to get you to make statements to them (don't talk to them, everything you say will be twisted and used against you) 2. The cops will issue an arrest warrant for you. Depending on the jurisdiction you may be able to arrange for a walk through booking process. It does not matter if the officer has or has not finished the police report or if your girlfriend told the cops that she did not want to file a report. If cops were called and they believe a domestic violence occurred, then a report will be generated. During this process, the cops will prepare an arrest warrant, which goes to a judge to sign, once it's signed then it's active in the system within a few days. You can check with the court to see if a warrant has been issued. Then hire a criminal defense attorney to defend you and help you at the bond hearing.

Can I expunge details from my criminal record?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Class C is far different than a state jail felony. You need to call a post conviction attorney for a writ of habeas corpus and try and undo it. Yeah that's a huge issue. In Houston I would recommend Josh Shaffer, Troy McKinney or Brian Wice. All are very good, but also very expensive. But what's your life worth to you?
