Am I criminally liable for the fraud committed by another person?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
Your risk is minimal if you were not involved and were unaware of the illegal acts but you may be required to return the items. Call an attorney to discuss the matter and to make the contact with the law enforcement personnel.

Do you try to get the charge expunged?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)

There is not deferred after probation - it is one or the other. And, you so not qualify for an expunction. If you successfully complete the deferred, then you must wait for 5 years before the judge can even consider sealing (nondisclosure) of your record.

Is a conviction of truancy I received as a minor cleared when I turn eighteen?

Cynthia Russell Henley

You probably were not convicted of truancy but instead given deferred disposition which is like probation but at the end of the probationary period after you have completed all the requirements, including community service and payment of fines and fees, the case is dismissed. You will need to check with the court in which the case was prosecuted to be certain of the actual final disposition. If instead you were actually convicted of the offense (which I highly doubt), then the conviction remains on your record. However, it is a class C misdemeanor which is equivalent to a traffic citation. Be certain that the question you are answering does not limit the offenses you must report to those which could result in jail time or are a Class B or higher offense.
