Is it possible to get an expungement from a misdemeanor that happened 15 years ago?

Nicole W. Moss
Answered by attorney Nicole W. Moss (Unclaimed Profile)
Criminal Law lawyer at Law Office of Nicole W. Moss
No. Currently in New Mexico there is no way to have a criminal charge expunged from your record under the scenario you described. There is a way to sometimes expunge a criminal charge if the defendant was factually innocent. In those cases, you can sometimes obtain a court order to expunge the record, however, even then it is extremely difficult to completely erase it.

Can the state/police still press charges even if there was no arrest and the other person isn't pressing charges?

Answered by attorney Evan Ephraim Zelig
Criminal Law lawyer at Law Offices of Evan E. Zelig, P.C.
Yes they can. If there is probable cause for an arrest warrant and the belief you committed a crime the DA can request and a judge can issue a warrant without initial arrest and without the other party desiring charges against you. It is important not to make any statements to law enforcement and to protect your rights by contacting an attorney.
