I’ve made a car payment on my vehicle and it is being kept from is this legal or illegal?

Peter David Ticktin
Answered by attorney Peter David Ticktin (Unclaimed Profile)
Criminal Law lawyer at The Ticktin Law Group
It's a little difficult to understand your question. Is it a criminal question. A lot depends on the paperwork you signed and what you agreed to do. Was your car repossessed and then you made a payment. Please add some more information in your question so we can understand the situation. If your car was repossessed then there is likely a legal case regarding your contract. Also have you contacted the finance company asked them why.

Can I get a possession charge dropped if the illegal drugs were found in car that I don’t own?

Gregory Casale

Possession is a fact based determination. Therefore circumstantial factors will determine whether or not you can be convicted of possession in your case. Your lawyer should file a motion to suppress the evidence and make the argument that you had no knowledge of the drugs being inside the vehicle. Knowledge is an element of possession and like all elements of any charge, they must be proven beyond a reasonable doubt. If the drugs were in a secure place of the car such as the trunk or glove compartment your chances will be better than if the drugs were on the seat next to you. These are extreme examples of two ends of a spectrum that your facts probably fall in the middle of.

I was arrested and charged with 12 counts of credit card fraud and grand theft.

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
I could not determine what your question is.  However,  it seems as if you may be wondering if you need legal assistance since you are innocent.  In my opinion, you should not assume that, because you are innocent, the case will just go away.  Even innocent people can, and do, get convicted. If you cannot afford to retain a private attorney, you need to ask the court to appoint the Public Defender to represent you.   If the court/clerk of court determines that you have sufficient funds with which to hire an attorney, the Public Defender's Office will not be appointed to handle your case.  In that event, if you want legal representation, you would need to retain private counsel.
