Can my son be arrested for minor in consumption of alcohol if he was never tested?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
The answer depends on what happened to convince the officer that your son had consumed alcohol. The test is a zero tolerance one, so any amount is enough. If your son admitted to having been drinking the court can find him guilty.

As long as you are not sending repeated messages that are harassing her, and you are simply telling the truth, you have no problem. (Truth has to do with the potential?civil lawsuit. She does not owe you - he does. IMHO and having been on the receiving end of same....)

How should I answer a job application question when I was charged with stealing but it was amended?

Since one is innocent until proven guilty, questions about arrests are unconstitutional and you can honestly state that you have no criminal convictions. More importantly, you should hire a lawyer to Petition to Expunge your old arrest a.s.a.p. so that this is never an obstacle again.
