Contact a lawyer before charges are filed if possible. This is a very serious charge that can result in penitentiary time. It is usually best to see a lawyer before answering any questions.

If the judge says that he cannot compel handwriting for written letters to blame another person, is this 5-6th amendment violation?

A judge does not subpoena anyone. The prosecutor and the defense may subpoena people to come to court to produce evidence or to testify. As far as letters, they are not admissible in evidence except at certain punishment hearings - such as when someone pleads guilty to the judge to allow him to decide the sentence.

How do I find out if my attorney had an ALR hearing for me?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Call the State Office of Administrative Hearings in your city of arrest. Or better yet, ask your attorney to see your file. After all, they work for you and it's your file.
