If they served the mother with a subpoena, then per article 24.011 of the Texas code of criminal procedure the child is deemed served also. The DA would have the right to send the sheriff out to arrest both the parent and the child if the child did not appear at the time and date required by the subpoena. Self-defense is a valid defense to Assault & Battery. You now have to convince the judge or jury that you were not the aggressor, but that you were in fact defending yourself from the actual aggressor. Witnesses and defensive injuries are your best bet.

Don't do anything without first consulting an attorney. It sounds like money is tight for you right now, so if you can't afford to hire a lawyer, just go to your court date and ask the judge to appoint the public defender to represent you. Public defenders are attorneys as well. You need to have an attorney review your case and advise you on the best course of action. Good luck. First time petty theft offenses are usually eligible for diversion in most jurisdictions, which means that you jump through some hoops and stay out of trouble and they dismiss the case.
