Can I own a registered gun although my husband is a convicted felon of drug possession?

default-avatar
Answered by attorney Michael Thomas Lynch (Unclaimed Profile)
Criminal Law lawyer at Michael T. Lynch
The status of your husband should not effect your ability to own a firearm. However, you husband cannot own or possess a firearm. If the storage of your firearm allows access by your husband he can be seen as in violation. If you owned the firearm, but it was kept at the residence of another, assuming your husband did not have access to that residence, it should be fine. Additionally, if the firearm is kept lock in a safe in which your husband does not have the combination, it should be sufficient. The key is access, not your ownership.

Do i lose a traffic violation case if officer shows up for court?

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
You don't necessarily lose a traffic violation case if the officer shows up to court. You are still entitled to a trial on the merits of his accusation. If the officer's testimony proves you committed the violation, of course you will be convicted. But, it is always your right to fight the case.

Can I get a DWI after passing the test?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
First, you apparently got arrested for DWI so it can happen. Second, even if you think that you "passed" the field sobriety tests, the officer did not (or at least will say that he did not, which is why he arrested you.) If you had nothing to drink, the you should have few worries even if you did not do perfectly on the FSTs. Few people do. You will likely want to get the bouncer's name and contact information to be a witness that you arrived at the bar & had nothing to drink. You will also need any other witnesses that you were around that can testify to your sobriety. Finally, you will want your cell records to demonstrate the time of the calls, etc., and the lack of opportunity to drink. You definitely need a lawyer ASAP. There is a 6 months license suspension in the works for refusing the breath test. You must request a hearing within 15 days of your arrest or you license will automatically be suspended beginning on the 40th day after your arrest.
