  Represented Static Control in consolidated cases concerning aftermarket for repair of toner cartridges for certain Lexmark laser printers. Lexmark alleged patent infringement
  active inducement of patent infringement. Static Control alleged patent misuse. Jury verdict for Static Control.
  Lewis v. Bayer (Court of Common Pleas, Philadelphia)
  Represented Bayer in medical monitoring litigation resulting from the withdrawal of Baycol, Bayer's cholesterol reducing medication. The Court granted Bayer's Frye motion to prevent plaintiff's key expert from testifying. The Court subsequently granted Summary Judgment for Bayer shortly before trial.
  DuPont v. Merck (New York)
  Represented DuPont in one week arbitration hearing concerning royalties owed under agreement relating to Losartan anti-hypertension drug. Obtained award in favor of DuPont.
  REPRESENTATIVE CASES: Criminal Activity Surveillance v. ADT (Eastern District of Texas), Bosch
  Tyco v. Criminal Activity Surveillance, (District of Delaware)
  Represent ADT/Tyco in patent infringement matter involving patent on surveillance technology. The case brought by CAS in Texas was dismissed. The declaratory action brought by Tyco in Delaware is pending.
  DuPont v. MacDermid (United States District Court, New Jersey)
  Represent DuPont in patent infringement suit against MacDermid. Patents relate to thermally processed flexographic printing plates. Case ongoing.
  Imprelis Litigation (MDL, Eastern District of Pennsylvania)
  National counsel for DuPont in product liability litigation, including putative class actions pending in an MDL in the Eastern District of Pennsylvania, alleging damage caused by DuPont's Imprelis herbicide.
  In re Bayer Corp. Combination Aspirin Products Marketing
  Sales Practices Litigation (MDL, Eastern District of New York 2008)
  Represent Bayer Corporation in numerous proposed class actions brought by consumers who purchased aspirin products.
  In re National Century Financial Enterprises, Inc. (MDL Southern District of Ohio)
  Represented Deloitte & Touche LLP in multibillion dollar lawsuits relating to the collapse of one of Deloitte's audit clients, National Century Financial Enterprises, Inc. All claims against Deloitte have settled.

  Represent AstraZeneca Pharmaceuticals in mass tort litigation regarding Seroquel(atypical antipsychotic).
  Sikorsky Aircraft Corporation v. United States (Court of Federal Claims)
  Represented Sikorsky in $80 million accounting dispute with the federal government. Judgment for Sikorsky, court rejected government claim in its entirety.
  YAZ/Yasmin Litigation (MDL, Southern District of Illinois)
  National counsel for Bayer in litigation alleging personal injuries caused by YAZ
  Yasmin (oral contraceptives). Cases pending in federal
