Can I file bankruptcy on my home if I'm under a rent to own contract?

Yes, you can. If you are a renter and not the owner of the house, the house is not part of the bankrupt estate. Assuming that you otherwise qualify for bankruptcy, you can file a chapter 7 bankruptcy. Your contract to purchase the house will likely be considered an executory contract which means you can elect to either assume or reject the contract in bankruptcy.

IIf I have been discharged from a chapter7, can I add some more creditors to my file or can I give them my old case number?

Hopefully you are represented by an attorney - ask them. If you are not represented, then it depends on: 1) Whether you knew about the debt before filing and purposely left it off your documents - no 2) Whether the debt was incurred after filing - no 3) Whether your case is an asset case maybe, but you need to amend immediately before the end of the proof of claim deadline.

If after a divorce that I when through, I ended up in a a lot of debt and I filed for bankruptcy in 2005, can I file again after 8 years?

Stuart Anthony McKenzie
Answered by attorney Stuart Anthony McKenzie (Unclaimed Profile)

If you received a discharge in a Chapter 7 case in 2005 you can file another Chapter 7 bankruptcy 8 years after the 2005 bankruptcy was filed. You count the eight years from the date the 2005 case was filed not the date of discharge. For example if the 2005 bankruptcy was filed on June 1, 2005 you can file another Chapter 7 on June 2, 2013. Different rules apply with respect to Chapter 13.
