What do I do with a credit card summons?

Answered by attorney Charles Reiger Gallagher
Bankruptcy lawyer at Gallagher & Associates Law Firm, P.A.
You need to retain an attorney. You have been served with a lawsuit and must respond to the Complaint and/or appear at the hearing which is noted in the summons. What you say, or don't say, can be fatal at the hearing and it underscores the need for an attorney. For example saying that you agree you owe the money, but you just don't have it, will result in a swift judgment against you. Such statements amount to a waiver of your legal and factual defenses.

Can you keep your home but include an equity line of credit on your home in a bankruptcy?

Answered by attorney John Schleiffarth
Bankruptcy lawyer at JCS Law
If you are filing a chapter 13 bankruptcy and the home is valued at less than the amount of the first mortgage, you can likely strip off the second mortgage and still keep your home. You should speak with an experienced bankruptcy attorney in central Florida. Initial consultations are usually free.

What can we do about the second mortgage?

default-avatar
Answered by attorney Edward M Olson (Unclaimed Profile)
Bankruptcy lawyer at Olson Law Firm
It is not clear what your situation may be. For example, if the mortgage and equity line were discharged in bankruptcy, then there is nothing more you need to do. The second mortgage holder became an unsecured creditor and was entitled to the same treatment as all other unsecured creditors.
