What are our options if we want to enforce the sale contract?

Jeremy B Shephard
Answered by attorney Jeremy B Shephard (Unclaimed Profile)
Bankruptcy lawyer at David Andersen & Associates, PC
Sellers debts/obligations up to filing their Chapter 13 would be included in their Chapter 13. The bankruptcy doesn't protect the sellers for actions after their filing. If they choose to breach their contract then you can enforce your legal options. It would be worth finding out if the sellers have received permission from the bankruptcy court to sell the property because that is often needed before they can.

Why hasn't my attorney filed the paperwork yet?

You are going to have to get in touch with your finance company. The creditors should not have accepted payments if the debts were unsecured credit card debts which were discharged. Or they should have refunded those to you. If these were secured debts, like for a car, you had to pay to keep your car. You could try 2 other options. One is suing the lawyer for malpractice and the second is to file a claim with the state bar. Problems like this is probably why he was disbarred.

Can a bankruptcy trustee force the bank into a deed in lieu of foreclosure?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
I suppose a bankruptcy trustee can convince a bank to take a deed in lieu, but forcing them to take a deed in lieu would not be the correct terminology. A trustee can only force certain things, and this is not one of them.
