Yes, they can because you did not go to court to get the order terminated. There is a possibility that you can do that now, but it will require your soon to be ex to agree that the two of you were living together or, perhaps if she won't, other people to testify that you were living together. I suggest you talk with local family law counsel to figure out what you can do.

Student loans are generally not discharged in Bankruptcy. If an Adversary Proceeding wasn't filed, they were not discharged. Listing all debts is mandatory. It's not a list of debts you want discharged, it's just a list of your debts. Certain student loans have no grace period for the parents. I know a Direct PLUS loan is one of these.

If a mortgage is fully paid and discharged by the bank, does the Note stay in tact as a fully due and payable debt?

The Note is the personal obligation. The mortgage is only a lien on the home. If you do not have proof that the Note has been fully satisfied you still owe it.
