There are several factors that come into play after a bankruptcy is filed to determine whether property is retained by the debtor and any co-owners. It depends mainly on whether the property is claimed exempt. Assuming the property has little or no equity it probably can be retained. This is a complicated issue and you should seek the advice of an attorney who is a certified specialist in bankruptcy law. consult the State Bar for a listing of those attorneys in your area.

Do both parties have to sign the agreement if both names are on the home title?

An individual can file Bankruptcy without the ex-spouse's consent after divorce. You might want to review his bankruptcy filing to see what happened to the house. If it was sold to pay his creditors, this may have an effect on your credit rating. He probably couldn't refinance the mortgage to get your name off the loan.

What can I do as a co signer if the debtor has filed for bankruptcy?

Answered by attorney Jackie Robert Geller

Unfortunately, you are responsible on the loan because you co-signed and became a joint debtor. Your father should do the right thing and help you pay for the car.
