You should consult with an attorney on the divorce and financial issues now. If she bankrupts you will still be liable on our personal as well as joint debts. She will be potentially discharged on the joint debts.

It depends on when you filed, what Chapter you filed under (e.g., 7 or 13), and what the disposition of the case was (discharge, dismissal, etc.). For example, you have to wait 8 years file a subsequent Chapter 7.

Can the lean holder file suit against the co-signee?

Melissa Ann Botting
Answered by attorney Melissa Ann Botting (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Melissa A. Botting
As long as you are in bankruptcy there is a co-debtor stay. The lender cannot try to collect from your co-signer. If the court accepted the plan the mortgage company did not need to confirm. If the court approved plan is completed, the debt is paid.
