I have 4 loans through 1 bank and plan on bankruptcy, can they repossess my vehicle with them even if current on payments?

They shouldn't repossess it if you are current on the payments. You can read the loan documents to make sure what they have to do to repossess the vehicle.

What rights do we have to prevent the credit card company from tying the credit card balance to the car loan?

Answered by attorney Marjorie A. Guymon
Bankruptcy lawyer at Goldsmith & Guymon, P.C.
You need to bring it before the bankruptcy court. You need to have someone review the reaffirmation agreement you signed. If it ties the credit card account with the vehicle loan then you'll be forced to pay it but could probably get the bankruptcy court to help you revise the payment schedule.

If I own a car free and clear but file for Chapter 7 Bankruptcy, can they take my car?

Jeffrey David Solomon
Answered by attorney Jeffrey David Solomon (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Jeffrey Solomon
If you have been a Florida resident for 2 years, you would use Florida exemptions. You can exempt $1,000 in value against a car and if you do not receive the benefit of a homestead exemption, and additional $4,0000 in exemptions is permitted. You have an additional $1,000 that can be used to protect personal property(including furniture) Some trustees will accept short term payment plans, others do not. This is often a problem in chapter 7s.
