Is it a good idea to file bankruptcy after a house fire?

Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
Given the fact that there is a claim and anticipated proceeds those would most probably be considered as part of the bankrupt estate. You should certainly see counsel before you take any action. Neither the law nor the creditors are is foolish as you might like.

Can an ex-husband put a lien on my house?

Answered by attorney James T Weiner (Unclaimed Profile)
Bankruptcy lawyer at James T. Weiner, P.C.
Generally no your ex cannot put a lien on the house... especially if it is owned jointly by you with your new husband. Further I believe that if he attempts to put a lien on your house without court approval it is a crime and you can have him put in jail plus large fines.

Do I need to replace my attorney and if so can we delay the confirmation until the new attorney gets this case under control?

I have heard your side of the story, but it often takes a judge to decide if something is malpractice or not. I am sure if I asked your current attorney he would have an explanation of what has caused the delay and would have business records to back up his story. The court & the trustees often demand things, but that doesn't mean your attorney hasn't performed his job in an appropriate way. You would need to have an expert review your file in order to see if replacing your current attorney would be possible.
