Can a bankruptcy record be expunged before 10 years?

Federal law says that the credit bureaus may report your bankruptcy for 10 years. I find it hard to swallow that you think that this law is unfair when it was your choice to file the bankruptcy and if you were in a Chapter 13, you received this benefit each & every day for at least 3 years. There are plenty of other things you can do to improve your credit besides removing your bankruptcy from the report. Most lenders only consider your FICO score when granting you credit, and as time passes, your bankruptcy discharge will become less & less important. If one lender won't accept you because of your bankruptcy, you should try another. Chances are pretty good that the bankrutpcy discharge is an excuse for denying you and that it is your history of bad credit decisions over many years that is preventing you from obtaining a mortgage loan.

If your ex is filing chapter 13 and is current with his child support and alimony do I have to file any claim so it continues?

Support obligations are not dischargeable in bankruptcy. You do not have to do anything except that if he misses payments perhaps file a motion for contempt. The life, medical and dental insurance obligation is directly related to support and if he fails to maintain those policies, he can be subject to contempt.

Can your wages be garnished for a defaulted student loan?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
They would first have to file a suit against you and get a final judgment before they could garnish wages. Any judgment creditor can garnish wages, not just the IRS. But Florida has a head of family exemption which basically states that if you are the head of a family your wages cannot be garnished. In order to be a head of family you have to provide more than 50% for a child or other dependent. Your wages can be garnished by anyone who has a judgment against you. A collection agency who does not have a judgment cannot garnish your wages.
