Can my wife file for bankruptcy without using my income for the means test if we live in different households?

Susan Green Taylor

I had clients who had long been separated & had disparate incomes. His contribution to her household was noted, but their incomes were not combined for means test purposes. However, if your intent is to someday reunite, I think you would get push back from your U.S. Trustee's office.

Will filing Bankruptcy effect my possible personal injury settlement

Answered by attorney Warren V. Norred
Bankruptcy lawyer at Norred Law, PLLC
If you file bankruptcy while the lawsuit is pending, the trustee in the bankruptcy case can settle the lawsuit. And if you file the bankruptcy, you MUST list the suit, or you will lose the funds completely.  Best to wait until after the settlement.

If sheriffs gives me a 5 day notice can I file for emergency bankruptcy?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
Using a bankruptcy to stop a forcible entry and detainer is overkill. You cannot get a bankruptcy off your credit by dismissing it. Bankruptcies need to be filed with forethought and done very carefully. See if the new owner will give you more time by you paying rent for the period that you need.
