Generally yes, but you will be losing the "equity" you may have built up as a result of the contract. See an attorney to determine if bankruptcy is you best, or presently necessary, alternative. It is a major step and not to be use lightly.

Can a HELOC be discharged with chapter 7 bankruptcy?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
A chapter 7 would discharge the debtor's obligation to pay the debt, but it does not remove the lien on the real property. You might accomplish this in a chapter 13, but it depends on the facts. Please understand that filing for bankruptcy is a very complicated process. It is wise to talk to an experienced bankruptcy attorney before deciding to take this important step. Most Arizona bankruptcy attorneys offer a free consultation about the basics of bankruptcy.

Will the bank modify the loan to remove the husband's name?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
The bank probably will not modify the loan to remove the husband's name. It appears it would be best to refinance in the wife's name only, so that the husband is no longer on the mortgage.
