I am not certain of the facts you are presenting. Was there land contract entered into by both you, in which case your father is discharged but you are still liable. Really you should see an attorney, explain all of the details and get firm advise. It is cheaper to do it right the first time than to correct it later. Additionally you should be engaging your own counsel, your dad's attorney represents him, and NOT you.

You do not have to reaffirm a mortgage to keep your home. Doing so is an incredibly risky thing to do. Ignorant people at your mortgage company may claim that you don't qualify to refinance with them because you did not reaffirm but even if you had reaffirmed there would be no guarantee that this lender would refinance you. If you qualify to refinance with someone else, they may wish to see your payment history with your current lender but they shouldn't care if you reaffirmed this debt or not.

What you are requesting isn't possible because it would involve the attorney telling a lie. Your attorney can lose his/her license by doing this and if you can't take "no" for an answer, I can't blame your attorney for ignoring you. You are asking your attorney to commit a crime. Knock it off and find another way to solve your rental issue.
