If my lawyer did not include my car lease in my chapter 7, what should I do?

Answered by attorney Max L Rosenberg
Bankruptcy lawyer at Rosenberg Hite, LLC
It sounds to me as though your car company is trying to pressure you into filing A reaffirmation agreement. My advice is to leave the bankruptcy closed. As long as you keep making your monthly payments they should not be allowed to repossess your vehicle. You do not have to file any statement of intention in order to keep your vehicle. A reaffirmation agreement only favors the creditor in most circumstances.

How can I get the title of a car I bought after filing for bankruptcy?

Answered by attorney Austin M Hirschhorn (Unclaimed Profile)
Bankruptcy lawyer at Austin Hirschhorn, P.C.
You need to go to the Michigan Secretary of State office nearest to you and make application for a title. You can tell them that you never got the original title or that it was lost. They will tell you what you have to do. I am sure you will need the VIN # for the car and the year it was made, the model information and the make.

One of my creditors has sent one of my accounts

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
Don't take legal advice from your creditors.   That's rule #1.   If you file a bankruptcy case and receive a discharge, the discharge will include all debts that you owed on the date your bankruptcy case is filed.  So, if you incurred the debt you mentioned in May 2013 and file your Chapter 13 after that, the debt should be discharged unless it falls into one of the types of debts excepted from discharge. These exceptions include debts incurred through fraud, domestic support obligations, certain taxes and others.   As a final thought, if your lawyer is too busy to answer your questions, you may have picked the wrong attorney. Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.
