What do I do if a dismissed bankruptcy is charging me association dues?

Answered by attorney William C. Wood (Unclaimed Profile)
Bankruptcy lawyer at Law Office of William C. Wood, LLC
I assume you mean a discharged bankruptcy, as opposed to a dismissed bankruptcy. While, pre-filing homeowner's association dues are dischargeable in a bankruptcy, dues that accrue post-filing are not. You would be responsible for any dues that accrue from the date of filing of the bankruptcy until the property is transferred out of your name via sale, foreclosure, etc.

What will happen if my husband files for bankruptcy?

Answered by attorney Christopher J. Kane
Bankruptcy lawyer at Christopher J. Kane, P.C.
If you were a co-signer on that auto loan and the vehicle is repossessed, the lender will sell the vehicle and if it sells for less than what was owed on the loan, there will be a deficiency balance your husband can walk away from if he files bankruptcy. Yes, you will remain liable for that balance (as well as any other joint debts you may have with him). Just because he had the car does not relieve you of that responsibility. I suggest that you meet with an experienced bankruptcy attorney like myself so you can determine whether you should file bankruptcy as well.

I filed a chapter 7 and want to know how much of my State or Federal Tax Return the court or trustee will take?

There may be a portion you could keep. There are ways to keep a lot or all of a refund, but you need an experienced professional to help you. It depends on your marital status, whether you listed a potential tax refund on Schedule B, the amount of the earned income tax credit and the exemptions claimed on Schedule C(assuming you properly listed the refund on Schedule B) and the date you filed the bankruptcy case (the later in 2012 you filed for bankruptcy, the less you might be able to keep).
