First of all, if your husband's attorney is doing anything other than trying to get the best result for your husband, he's committing an ethical violation! His job is to get the best result for your husband. I think it may be a terrible decision to dismiss the Chapter 13 but there is no way to tell. You have a bk attorney so have him/her help you out with this. If they don't know then you need your own bk attorney that is familiar with family law to help you.

You cannot file bankruptcy on most student loans and if you are co-signer you will be responsible for these debts. Also, the lenders are probably reporting the non-payments on your credit reports so you should help as much as possible to protect your credit

You are not arrested or jailed for failure to file an answer or appear in lieu of an answer. Once there is a judgment, however, the judge may order you to appear for an examination of your assets. That type of court order can result in a warrant for your arrest in you fail to appear. Consult a local attorney for advice in this matter. This is applicable to California law. Illinois law may differ.
