What will happen if I put a car under my grandson's name then filed for bankruptcy?

default-avatar
Answered by attorney Tony E. Carballo (Unclaimed Profile)
Bankruptcy lawyer at Carballo Law Offices
If your grandson is a co-debtor (his name on the loan) on the car loan then he owes the money. If he is just on title then he does not owe the money. If he owes the money then nothing you can do about it.

Am I eligible to file a chapter 13 if I was discharged from one before?

Answered by attorney Jeffrey M. Cook (Unclaimed Profile)
Bankruptcy lawyer at J.M. Cook, P.A.
There are specific timing deadlines relating to discharge and stay provisions. However, there is no time limits for refiling; you may simply not be eligible to receive a discharge of a debt. That wouldn't affect your ability to file a new plan to address the shortfall on your mortgage.

Will the new trustee take into account my new job?

David Michael Benson
Answered by attorney David Michael Benson (Unclaimed Profile)
Bankruptcy lawyer at Benson Law Firm
In many jurisdictions, you must report to the Trustee when your income increases more than 10% from the amount listed on Schedule I. In our office, we ask clients to report any increase (or decrease) in income to us so that we can decide whether the Trustee needs to be notified. I would suggest you discuss this matter with your attorney ASAP.
