If you filed a Chapter 7 in 2006, you cannot file another one for 8 years. However, you would qualify to do a Chapter 13 right now. In a Chapter 13, you would have a minimal monthly payment on your bills for cents on the dollar.

Normally the bank will not remove someone's name from the loan documents. The borrower can refinance which will remove the name. But that is a challenge in today's situation where the property is worth less than the debt. On the other hand, the title can be conveyed by the borrower, assuming there are no limitations in the loan documents. If bankruptcy is involved the conveying spouse needs to make certain they are not conveying an asset for less than fair market value. It is always wise to obtain competent bankruptcy advice before filing for bankruptcy. Most consumer bankruptcy attorneys offer free consultations.

When you signed a quitclaim deed you gave up your ownership rights. You were not released from the Note. The modification of the mortgage probably did not add any additional obligations above and beyond the obligation already under the Note. If your ex was supposed to refinance, that is a different issue. That would have released you from the Note. I would recommend that you file a "Motion to Enforce Litigants Rights" under your divorce docket to compel a refinance, regardless of the modification if you want to be released from the Note.
