If we want to do a REFI on our home will we have to add the balance of the 2nd on there or is it considered forgiven?

John A Moffa
Answered by attorney John A Moffa (Unclaimed Profile)
Bankruptcy lawyer at Moffa & Breuer, PLLC
As to your question: will we have to add the balance of the 2nd on there or is it considered forgiven it is difficult to explain, but I'll try. If you did NOT reaffirm the debt, then YOU have NO PERSONAL liability to the bank for the second mortgage. HOWEVER, the bank does NOT lose its collateral for the loan (the second mortgage) and can look to the PROPERTY for payment, but cannot look to you for any deficiency. I hope this helps.

Why did we receive a Certificate of Release of Federal Tax Lien and what do we do?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
I think all you can know for sure is that the feds no longer claim a lien on your property. The existence of a tax debt, however, may not be affected. In other words, they probably can demand the money from you, but not foreclose on your homestead. Consult your bankruptcy lawyer. If you did not have one then, consult one now.

Is it possible for me to go to jail if I cannot pay my medical bill due to being jobless?

Mark Stuart Cherry
Answered by attorney Mark Stuart Cherry (Unclaimed Profile)
Bankruptcy lawyer at Mark S. Cherry, Attorney at Law, PC
Inability to pay is not subject to jail. The only risk of jail you may have is after they obtain judgment you must cooperate with the process to collect. If you fail to respond or ignore them they can ask a judge to find you in contempt which can get you arrested.
