What is the difference between eliminating debt and discharging debt for bankruptcy? How?

The distinction will depend on the type of debt that is discharged. If you discharge a credit card, you no longer have the legal obligation to pay on it and the credit card is cancelled. If you discharge a car loan, you no longer HAVE to pay it, but it you DON?T pay it, the lender will repossess the car. So the car loan has been discharged, because you don?t have to pay it, but the car loan isn?t eliminated because you didn?t just get a free car.

You can sue anyone for anything, the real questions is whether you can win. You might be able sue and win in this situation depending upon the circumstances. Where were the vehicles parked? What company towed them, and at who's request? Did you confirm any pick-ups with the lender? It is possible the lender picked them up and may be trying to unlawfully seek additional funds? There are a number of variables that need to be looked at before a course could be recommended. There is a possibility that you cannot do anything. You might not want to. All the variable need to be examined first. I would recommend you contact an attorney to discuss this matter in more detail.

I can answer that generally yes he can file, pretty much anyone can file, but whether it's a good idea and whether it will accomplish your specific goals will depend on more details. Chapter 13 is too complicated for individuals without practical experience in handling these cases to successfully do it on their own. Please. I strongly urge you. go visit a local competent attorney who has handled several of Chapter 13s, someone who has been around the block with these before, to ensure best results. About 99% of pro se Chapter 13s end up in dismissal. I assume you filed this bankruptcy to protect property or because chapter 7 was not an option or at least not a good option for one of several reasons. With so much at stake paying for proper representation could save not only stress and headaches but money and loss of property.
