Creditors may try to collect your medical bills from your spouse under the Colorado family expense doctrine, but the doctrine only applies to family expenses incurred during the marriage. Therefore, your spouse has a defense to any action or collection attempt.

If I am married and debt is all under my name can I go bankrupt myself only?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
You can file bankruptcy by yourself regardless of whose name the debts are under. But your spouse's income, expenses, assets and debts must be included in the filing (and analysis for eligibility). Make sure you hire an experienced bankruptcy attorney in your state to advise and represent you.
