The statute of limitations is a time-bar against filing a lawsuit.  If the statute has tolled, the creditor will not be able to enforce the agreement.  A breach of a credit card agreement must be filed before the statute tolls.  Each state has differing statutes of limitations, and you should contact a local consumer rights attorney to determine if the statute of limitations has tolled for any debts for which you maybe liable. No. Once you file the bankruptcy case, if the creditors contact you, you need to inform them that you filed the case and give them the case number and, if necessary, ask them never to contact you again. They will not stop calling you until they have your case number. However, if you hire counsel, the FDCPA forbids them to contact you once you have a lawyer; so, you just tell them not to call you again and instead call your lawyer.

Normally the bank will not remove someone's name from the loan documents. The borrower can refinance which will remove the name. But that is a challenge in today's situation where the property is worth less than the debt. On the other hand, the title can be conveyed by the borrower, assuming there are no limitations in the loan documents. If bankruptcy is involved the conveying spouse needs to make certain they are not conveying an asset for less than fair market value. It is always wise to obtain competent bankruptcy advice before filing for bankruptcy. Most consumer bankruptcy attorneys offer free consultations.
