Can I file bankruptcy during home foreclosure

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
You can file bankruptcy any time you want (assuming you are eligible to file under a given chapter). Whether it is "too late" or not depends on what it is you're trying to accomplish, and you don't provide enough information to even begin answering that question. For example, if your goal is to stop the foreclosure sale and use bankruptcy to catch up on the payments, then it is too late to file after the foreclosure sale has taken place. If your goal is to discharge any deficiency you owe under applicable state law after the foreclosure sale, then it's never too late to file, although there can be significant tax consequences depending on when you file your case.  You would need to discuss that with a tax attorney who has bankruptcy experience. Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.

What happens when you miss a bankruptcy court date due to hospitalization?

Daniel James Wiedecker
Answered by attorney Daniel James Wiedecker (Unclaimed Profile)
Bankruptcy lawyer at Debt Relief Legal Clinic
The best practice is to be pro-active with the trustee and Court/judge assigned to your case. Use the telephone and make the trustee and Court aware of illnesses, each will generally be compassionate and set a date for continued hearing(s) in your case, or even that your appearance is excused, if appropriate. It is important the petitioner seek competent counsel in the petitioner jurisdiction to determine qualifications and rights under Title 11 of the United States Code.

If we filed for bankruptcy, can we sell our hs to buy another?

Answered by attorney Warren V. Norred
Bankruptcy lawyer at Norred Law, PLLC
Yes, if you sell your house, the proceeds are exempt for six months. As long as you move timely, you should not have a problem.
