Could I somehow postpone any judgement in order to enough time for SOL to take effect?

Bankruptcy lawyer at Law Office of Andrew Kern
You could request a continuance from the court to delay a judgment, but the SOL is 10 years. Better to deal with the judgment now by either offering a settlement or filing a bankruptcy.

Once a debt has gotten to the point of wage garnishment, is it worth trying to go through a credit counsellor or is it better to file bankruptcy?

Answered by attorney Roberta Ohlinger-Johnson (Unclaimed Profile)
Bankruptcy lawyer at Harris, Yug & Ohlinger
In my experience, once a debt has gone to garnishment most creditors are past the point of making a deal. This is a point at which many folks file bankruptcy.

Is it true that an attorney will not file your bankruptcy until you paid in full and is a retainer stop an impending garnishment?

The attorney is only another unsecured creditor after filing, so most will not file until paid in full.
