What would be the risks if I co-sign on purchasing a house?

default-avatar
Answered by attorney Steven Jed Alpers (Unclaimed Profile)
Bankruptcy lawyer at Steven J. Alpers, A Professional Corporation
If this is a purchase money mortgage, no prior mortgages, they should only go against the property if there is a default. The only other problem could be if there is a short sale, not full loan amount. It is possible that your credit will be hurt if there are late payments. This could affect your credit score. This is really a family issue do you trust them? What happens if one is disabled or hired.

What should I do if I don't want my car repossessed?

They probably playing tough because you did not execute a reaffirmation agreement. I'd contact the lender & offer to execute a new loan on the car, if they'll agree. With your payment history, they should.

How would I know if I needed to file for chapter 7?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
You need to get into a Bankruptcy Attorney in your state. If the house is not in your name, there is no issue. If it is in your name and no mortgage in your name, then you will need to file a Chapter 13 to protect the house. The structured settlement will not be an issue, it really will depend on where it came from (underlying reason for a structured settlement). Also, you would need to show the attorney any other forms of income over the last six months and last three years of tax returns.
