If the bankruptcy was granted 5 years ago, you can't file again until 7 years have gone by since the last one. If it was not granted, you can file.

Bankruptcy laws allow you to keep a certain amount of property in a Chapter 7 bankruptcy case. Depending on what you own, you might not lose anything in Chapter 7 case. If you are not able to exempt all of your property, it may still be possible to keep the non-exempt property by filing a Chapter 13 case for debt consolidation and partial repayment.

If you wait until your six-month average is below the median, and if you file while she is not employed, then your past earnings are not likely to be a problem for filing Chapter 7.
