If your cosigner files bankruptcy, this may cause a "default" with the lender. The lender can require extra information from you, because your girlfriend is now not legally responsible on the loan. If you want to keep the bike, you still will need to cooperate with your lender. If you do not cooperate, they definitely can repossess and take the bike. These terms are usually included in any financing contract you and your girlfriend signed.

The answer is that the note and mortgage still govern the transaction. All that has changed is that the lender can only look to the property for payment, not to discharged debtors. So the lender can still raise or lower the payments, pursuant to the Note and foreclose if the terms of the agreement are not complied with. You are correct that your personal obligation to pay has been discharged. You can certainly sell the property and payoff the balance of the mortgage, but I would only recommend this if you are going to get money from the sale. Why try to short-sell a property that will inconvenience you by showing it when it does NOT affect your credit rating and does NOT get you any money. Banks seem leery to refinance these properties, but why a NEW lender wouldnt give you a mortgage if all other criteria is met, is a mystery to me.

You need to consult with an attorney to see what Chapter you either can or should file. With mortgage arrearages, you can pay the past due amount through a Chapter 13 plan while making the regular monthly payments outside of the bankruptcy plan. However, you may be better off surrendering the home if the amount owed on the mortgage exceeds the current value of the home. When your attorney runs the MEANS TEST for you, s/he can then best advise you which route to take.
