The answer is a little more complicated than it should be It's called an action in replevin. He has to file papers with the court and get a court order allowing him to go on to this person's property and take posession of his vehicle.

If I filed for bankruptcy about 10 years ago and I have $21,000 credit card debt, can I file again?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
If you received a discharge in the earlier case, then you must wait eight years from the date of filing the earlier case to the date you file your new case. So...you should have no problem in terms of time limits if you file a new case now. It's always a good idea to retain an experienced lawyer.

What do we need to do to qualify for bankruptcy?

Cary Sawyer Smalley
Answered by attorney Cary Sawyer Smalley (Unclaimed Profile)
Bankruptcy lawyer at The Smalley Law Firm, LLC
I suggest you talk to a bankruptcy attorney about the details of your situation and to see what Chapter you would qualify for. You are only able to keep one home under bankruptcy and your student loans generally are not dischargeable.
