How do I get my title back from the bank?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
The first thing to do is contact the bank. If that does not work, see if you can apply at DMV for another title. The bank may well have lost it.

Is there any possible way to keep a car when filing a chapter 7?

Michael Avanesian
Answered by attorney Michael Avanesian (Unclaimed Profile)
Bankruptcy lawyer at JT Legal Group
Yes, you can easily keep your car by exempting it. I suggest that you get an attorney though because while going through a Chapter 7 itself is not that hard, without the proper guidance you end up stressing out about many stupid things and once in a while terrible things happen. Why risk any of that.

What will happen to my 20 foot trailer if I filed chapter 7?

Answered by attorney Kathryn Ursula Tokarska (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Kathryn Tokarska
The answer depends. Do you have equity in the trailer? Often, when items are brought on credit there is very little equity, if any, at the beginning of the loan. If so, can it fit into one of the California exemptions: vehicle, wildcard, tools of trade? The last one may be applicable if the item is used as a tool in business. You say you are using the trailer to transport items for others and earning money for doing so.
