IN NJ: Yes, even if you file for Bankruptcy, you still have to pay child support. Pursuant to the Bankruptcy Code, child support is special, and you must continue making all Domestic Support Payments which includes alimony and child support. If you are filing a Chapter 13, in NJ, you must sign Certification stating that you are current on your Domestic Support Obligations before the Court will confirm your Plan.

Good question. The answer to whether a Chapter 7 or Chapter 13 will be better for you depends on your particular circumstances. Many Chapter 7 filers keep both their home and theirs cars, but they cannot have much equity in either. In order to file Chapter 7 you also have to pass a means test based on your income. I suggest meeting with a bankruptcy attorney for a personalized consultation. You will need specific legal advice based on your situation.

I had a Chapter 7 Bankruptcy discharged, do I have to surrender the property?

If you did not sign a reaffirmation agreement, the debt was Discharged in your Chapter 7. However, the lien on the title was not automatically removed. The secured creditor has a right to repossess the collateral (motorcycle) if you stop making the payments- totally up to them. If you are extremely lucky, the secured creditor will voluntarily release it's lien on the cycle. That is very unlikely, however.
