How can I get power of attorney for my boyfriend who is in jail?

Melissa Ann Botting
Answered by attorney Melissa Ann Botting (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Melissa A. Botting
First, nothing obligates someone to accept any power of attorney. Some institutions are concerned they may be forged or revoked and they will have some liability for accepting them. To increase your chances that your power of attorney will be accepted, you should have one prepared that meets the Texas statutory language. They are at least used to seeing that language in valid documents. As an alternative, he can sign documents to make withdrawals or deposits to his account from the jail.

Is criminal restitution excused on bankruptcy or not?

Answered by attorney Marjorie A. Guymon
Bankruptcy lawyer at Goldsmith & Guymon, P.C.
Criminal restitution is nondischargeable. However, your judgement in civil court is not criminal restitution. It is ordered by the criminal courts. You may still have a nondischargeability claim against her under another argument, such a willful destruction of personal property or conversion. There are deadlines to being these claims.

How much is a credit card and utility bankruptcy cost?

default-avatar
Answered by attorney Emily Marie Chase-Smith (Unclaimed Profile)
Bankruptcy lawyer at Corfield Feld LLP
Bankruptcy costs are relative to the time the attorney believes it will take to complete the file. The level of debt is relevant, as are the assets. One of the other factors is income and how it's earned. Self-employment can be time consuming to present to the court. The most simple bankruptcies are where the parties are traditionally employed and the debts are credit cards or medical. Those are less expensive.
