The better question is why would you want to file bankruptcy. You have been misinformed about what bankruptcy is and what it does. Bankruptcy will not eliminate your obligation to pay ongoing living expenses, or taxes on real estate. And for you to ask where a bankruptcy is filed tells me you are not able to put together the complex paperwork that bankruptcy requires. Frankly, you are not going to be helped by bankruptcy, nor do you need bankruptcy. Look for advice on asset protection instead.

You can dismiss a Chapter 13 a couple of ways ? 1st, by filing an ex parte motion to dismiss or 2nd, by failing to make plan payments. To vacate or expunge a Chapter 13 would require proving that you did not authorize the filing of a chapter 13 and were the victim of an identify theft.

No, I do not think you could so easily assume liability for someone else's prior taxes merely by helping to support him, thereby gaining the ability to declare him as a dependent on your income tax return. I hope that filing Chapter 7 bankruptcy gives him and you the fresh start it is meant to do.
