When is the latest I can file Chapter 13 to stop a foreclosure auction sale on my home?

Answered by attorney Willie Stephen Graves (Unclaimed Profile)
Bankruptcy lawyer at Graves Law Firm
Your home is not scheduled for a foreclosure auction sale today. In Texas the sale can be set only for the first Tuesday of a calendar month. You can file a Chapter 13 and stop the sale at any time before the sale begins. Your notice of the sale should give the earliest time at which the sale will begin. Bear in mind, however, that you must complete a debtor education course BEFORE you can file.

What actions can be taken against a co-signer on a car in Texas?

?1301 of the bankruptcy code generally prevents a creditor from going after a co-debtor/co-signer while the Chapter 13 is progressing. The lender can file a motion to lift the automatic stay and if granted then pursue their normal collection efforts. However, if the vehicle is being paid for through the plan then the odds are not very likely that the judge will grant the relief.
