How long do I need to wait before I can do another chapter 13 bankruptcy?

Answered by attorney Jacob D DeGraaff (Unclaimed Profile)
Bankruptcy lawyer at Henry DeGraaff, PS
If you have incurred new debt since filing in July, this may be an instance where you want to dismiss your case (or let it dismiss by not making payments) and re-file a new case. Of course, while you are out of bankruptcy, you will be without the protection of the automatic stay and will be subject to collections.

Do you have to reaffirm mortgages to get refinanced?

Answered by attorney Jeffrey M. Cook (Unclaimed Profile)
Bankruptcy lawyer at J.M. Cook, P.A.
No,the lender could give you a new loan regardless of whether you reaffirmed the original loan - they just don't want to. It is nearly impossible to go back to court and reaffirm a mortgage after the case is closed, regardless of what the lender tells you.

Lawyer moved to Texas without doing anything on my case, taking my down payment with her. What recourse do I have?

Answered by attorney Michael D. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
You can sue her in NY.  Also, you should file an ethics grievance with the bar.  A sanction in New York can be reported in Texas too, and might be your biggest stick.
