If you simply want to be rid of the partner and the business, you may simply gift your interest back to your partner. There may be tax consequences. Also, the gift will not affect liabilities that arose before the gift was made. Discuss this with your attorney as soon as possible. By doing nothing, you may be exposing yourself to additional liability.

You may want to find a law firm that does a large number of bankruptcy filings and ask them if they do "pro bono" (free) or reduced fee work. Some do. Good Luck!

You do not need to appear in court until you receive actual papers from the Court which tell you when and where the hearing is going to be held. Creditors sometimes claim that you are going to go to Court to try and scare you into paying the money. You need to contact an attorney who can advise you as to how to proceed if and when you receive the legal papers.
