Do I still have to wait years before I can file for bankruptcy?

Answered by attorney Kelly Nigohosian (Unclaimed Profile)
Bankruptcy lawyer at Able Legal Services, PLC
To answer your question, yes, you can file bankruptcy immdediately. However, since you are only allowed a discharge every 8 years, then you would have to file a chapter 13. A chapter 13 is a re payment plan that allows you to make payments to your creditors in an amount that you can afford. That amount could be as little as 2%.

When can I file Chapter 7 again if I have filed on 2009 and can I include my income tax debt in it?

If you are eligible, you can file a Chapter 7 every 8 years. Income taxes have to meet certain requirements to be discharged. A chapter 13 could be filed now, help with your income tax debt and other debts. The catch is that you have to pay something back to your creditors in a Chapter 13.

Is it right that the insurance company to go after my husband who stabbed our son to pay the hospital bill even if he is disabled and now in prison?

Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
If the care which you have it is titled solely in your name then there is no issue. It is a jointly owned by yourself and your husband then you should get his name off of the title. As for the insurance company, and is certainly within their rights to seek to be reimbursed for any expenses which they incurred as a result of your husband wrongful activities.
